Welcome to the We Manage Your Site, Inc. web app named QuickDash. By accessing or using the web app, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not use the web app.

“ZIP File” refers to the compressed archive file containing HTML, CSS, and JavaScript files that are uploaded by the user to QuickDash. for deployment to their Firebase hosting account.

You may be required to create an account in order to access certain features of the web app. You agree to provide accurate and complete information when creating an account and to update your information as necessary. You are solely responsible for the security of your account and any activities that occur under your account.

1. ZIP File Content:

You are solely responsible for the content and functionality of the ZIP file you upload to We Manage Your Site, Inc. We Manage Your Site, Inc. does not review, validate, or check the contents of the ZIP file, and is not responsible for the accuracy, appropriateness, or legality of the content in the ZIP file. You agree not to upload any content that infringes on any third-party rights, is defamatory, or is otherwise illegal. We Manage Your Site, Inc. reserves the right to remove any content that violates these terms and conditions or that it deems inappropriate, at its sole discretion.

1. User Content:

You acknowledge and agree that any content you upload to the web app, including the ZIP file, is solely your responsibility. You represent and warrant that you have all necessary rights and permissions to use and upload such content, and that your use and uploading of the content does not infringe on any third-party rights.

1. Intellectual Property:

All content on the web app, including but not limited to the design, text, graphics, logos, icons, images, and software, is the property of We Manage Your Site, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any content on the web app without the prior written consent of We Manage Your Site, Inc.

1. Reliance on Third-Party Plugins:

We Manage Your Site, Inc. is not responsible for the proper functioning of any third-party plugins, such as Simply Static or any other WordPress plugins that may be used by the user. You acknowledge and agree that you use such plugins at your own risk and that We Manage Your Site, Inc. is not liable for any issues arising from the use of third-party plugins. We Manage Your Site, Inc. does not endorse, support, or warrant any third-party plugins, and you are solely responsible for the selection, installation, and use of such plugins.

1. Payment and Refunds:

Should you feel that you are entitled to a refund, please contact our support via our website, where we will review your case and determine if a refund is justified, based on the terms and conditions herein. 

1. Termination:

We Manage Your Site, Inc. may terminate your account at any time, with or without cause, and without prior notice. If your account is terminated, you will no longer have access to the web app or any content associated with your account. Any unused time left on your account if you were on a subscription will be refunded to you.

1. Disclaimer of Warranties:

We Manage Your Site, Inc. does not guarantee the performance, reliability, or functionality of its web app or its services. The web app and its services are provided ‘as is’ and ‘as available’, and We Manage Your Site, Inc. disclaims any and all warranties, whether express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We Manage Your Site, Inc. does not guarantee that the web app or its services will meet your requirements, and will be error-free, uninterrupted, timely, or secure.

1. Limitation of Liability:

We Manage Your Site, Inc. shall not be liable for any damages, including direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the web app or its services, including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses.
